These Terms of Service ("Terms") govern your use of Brainy Day and its games, including LetterClash by Brainy Day (the "Services"), provided by Brainy Day ("we", "us"). By downloading, accessing, or using the Services, you agree to these Terms. If you do not agree, please do not use the Services.
You may use the Services only if you can form a binding agreement with us and are not barred from doing so under applicable law. If you are a minor, you must have permission from a parent or guardian.
Some features require an account or a matchmaking identity (for example, to be paired with an opponent and to save your games). You are responsible for activity that occurs under your account. You can delete your account and data at any time — see our Account & Data Deletion page.
LetterClash includes multiplayer play and chat. To keep the Services safe and fun, you agree that you will not:
We may remove content and suspend or terminate accounts that violate these Terms or that harm other users or the Services. If you encounter abusive behavior or content, please contact us at brainy@brainyday.app.
You are responsible for the content you submit (such as chat messages and your display name). You must have the right to share it, and it must not violate these Terms or the rights of others. You grant us the limited right to store and display your content as needed to operate the Services (for example, delivering your messages to the players in your game).
The Services, including their software, design, and content we provide, are owned by Brainy Day and protected by law. We grant you a limited, personal, non-transferable, revocable license to use the Services for their intended purpose. You may not copy, modify, distribute, or reverse engineer the Services except as permitted by law.
The Services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure.
To the maximum extent permitted by law, Brainy Day and its providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from or related to your use of the Services. To the extent liability cannot be excluded, it is limited to the amount you paid us (if any) for the Services in the 12 months before the claim.
We may update the Services and these Terms from time to time. If we make material changes, we will update the effective date above. Your continued use of the Services after changes take effect means you accept the updated Terms.
You may stop using the Services at any time. We may suspend or terminate access if you violate these Terms or to protect the Services and other users.
These Terms are governed by the laws of the State of New Jersey and applicable United States federal law, without regard to conflict-of-law rules, except where local law requires otherwise. You agree that the state and federal courts located in New Jersey are the proper venue for any disputes not otherwise resolved.
